Any dispute, controversy, or claim arising out of, or relating to, or in connection with this Agreement, including with respect to the formation, applicability, breach, termination, invalidity, enforceability or any dispute regarding non-contractual obligations arising out of or relating to such obligations shall be submitted to confidential arbitration at the BVW International Arbitration Centre located within the British Virgin Islands. The arbitration shall be conducted under BVI IAC Arbitration Rules (“Rules”) (in force at the time of submission of a Notice of Arbitration and as may be amended from time to time). One arbitrator shall be agreed upon by the parties, and where the parties cannot come to an agreement, an arbitrator shall be selected pursuant to the Rules. Arbitration shall be conducted in English and the arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. In the event that a provision of this Agreement is found to be unlawful, conflicting with another provision of the Agreement, or otherwise unenforceable, the Agreement will remain in force as though it had been entered into without that unenforceable provision being included in it.
If two or more provisions of this Agreement or any other agreement you may have with 911 are deemed to conflict with each other’s operation, 911 shall have the sole right to elect which provision remains in force.
We reserve all rights permitted to us under this Agreement as well as under the provisions of any applicable law.
